Other Family Law Matters

Family law is perhaps the most emotionally ridden area of law being practiced today. Due to the nature of family law, parties involved in a legal matter may face emotionally difficult and exhausting times. People are experiencing a roller coaster of feelings that make any family law issue highly sensitive.

Family law is a huge area of law that affects everyone. Any person with a family, spouse, child, or relative may find themselves in family court, or be affected by the outcome of a decision being made in family court.

Some other areas of family law include:

Paternity: refers to the determination of a child’s biological father. Paternity rights provide the father with legal rights and responsibilities regarding his child.  Under Paternity law, a man has the right to a paternity test if he believes he is the father of a child, but is not absolutely certain.  Paternity law also pertains to issues dealing with divorce, child custody, and child support.

Adoption: is the legal process of permanently placing a child in the home of a parent(s) who is not the child’s birth parents. Once an adoption is complete, the adoptive parents officially assume all legal rights and responsibilities for that child. When an adoption is finalized, there is legally and emotionally no difference between the adoptive child and a child born to the parents. There are two types of adoption: domestic and foreign/international. Domestic adoption involves placing a child from the United States into the home of the adoptive parents, where as an international or foreign adoption places a child not from another country into the adoptive home.

Grandparental rights: Child visitation rights do not only extend to the parents; grandparents also have rights regarding their grandchildren. Grandparents offer love, support, stability, and guidance to a child, and have the right to be a presence in that child’s life. Sometimes the grandparents can even receive custody of their grandchild if the parents are not suitable to be legal guardians.

Parental alienation: is the effort made by one parent to mentally and emotionally separate a child from his/her other parent.  Parent Alienation has been identified in psychology since the 1980s. No parent deserves to be alienated from his/her children because of the actions of his/her ex spouse. Parents have the right to a relationship with their child that has not been influenced or tainted by someone else.

Domestic violence: is the attempt to inflict or threaten to inflict psychological or physical harm to a spouse or family member. Types of domestic violence include physical threats, violence, sexual abuse, economic abuse, and emotional and psychological abuse. Domestic violence can occur between roommates, siblings, non-married partners, or relatives. Domestic violence is normally the result of one person wishing to maintain control over another person.
